FluxTribe Terms of Use
These Terms of Use ("Terms") are an agreement between you and Echotropy LLC, a limited liability company organized under the laws of Wyoming, United States ("FluxTribe," "we," "us"), governing your use of the FluxTribe app and fluxtribe.net (together, "the Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy and Consumer Health Data Privacy Policy.
The license to the app software itself is governed by Apple's standard Licensed Application End User License Agreement (EULA); these Terms govern the Service.
1. FluxTribe is not medical advice
FluxTribe is a recording and community tool. It stores the information you enter, shows reminders you set, and charts your data. It does not provide medical advice, diagnosis, treatment, or dose recommendations, and it is not a substitute for your doctor. Reminders reflect only the schedule you entered. Content posted by other users reflects their personal experience, not medical guidance. Always follow the instructions of your prescriber, and talk to a medical professional before making any change to your medication or health regimen. If you think you have a medical emergency, call 911.
2. Eligibility
You must be at least 18 years old to use the Service. By creating an account you confirm that you are 18 or older.
3. Your account
You are responsible for the accuracy of the information you enter and for activity under your account. Sign-in is through Sign in with Apple or an email verification code; keep control of that email and device. You may delete your account at any time in Settings → Account.
4. Community rules and content
You keep ownership of the content you post. You grant us a non-exclusive, royalty-free, worldwide license to host, display, and distribute that content within the Service, so the community features can work. This license ends for a given item when you delete it or your account.
Content you publish is visible to other users. Think before including personal health details in a post.
We have zero tolerance for objectionable content and abusive users. You may not post content that is unlawful, harassing, hateful, pornographic, or that promotes self-harm or eating disorders; you may not sell or solicit prescription drugs; you may not impersonate others or spam. Post text is screened by automated moderation before publication, every post can be reported in the App, and you can block any user. We may remove content and suspend or terminate accounts that violate these rules, and we act on reports within 24 hours.
5. Subscriptions and free trial
Parts of the Service require a paid subscription ("FluxTribe Pro"), offered as an auto-renewing monthly or annual plan purchased through your Apple ID.
- Free trial. Every new account receives 7 days of full access automatically. The trial does not require payment information and does not convert into a paid subscription by itself — you pay only if you actively purchase a subscription.
- Price and renewal. The price and renewal period are shown on the purchase screen before you buy. Your subscription renews automatically at the end of each period at the then-current price unless you cancel at least 24 hours before renewal. Apple charges your Apple ID account.
- Cancellation. Cancel any time in iOS Settings → Apple ID → Subscriptions. Cancellation takes effect at the end of the current billing period; periods already paid are non-refundable except as required by law or Apple's refund policies (request refunds from Apple at reportaproblem.apple.com).
- Changes. If we raise the price of your subscription, you will be notified in accordance with Apple's subscription rules and can cancel before the new price applies.
6. Acceptable use
You may not: reverse engineer, scrape, or disrupt the Service; access another user's data; use the Service to build a competing dataset; or use it for any unlawful purpose.
7. Our intellectual property
The Service, including its software, design, and branding, belongs to us or our licensors. These Terms grant you only a personal, non-transferable right to use the Service.
8. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you materially violate these Terms, with notice where practicable. Sections 1, 4 (license during its term), and 9–11 survive termination.
9. Disclaimers
The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and accuracy of records or reminders. We do not warrant that the Service will be uninterrupted or error-free. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.
10. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or for loss of data, arising from your use of the Service. Our total liability for all claims relating to the Service is limited to the amount you paid us in the 12 months before the claim arose. Nothing in these Terms limits liability that cannot be limited by law, and nothing in them waives rights you hold under the consumer protection laws of your state.
11. Governing law and disputes
These Terms are governed by the laws of the State of California, excluding its conflict-of-law rules, except that the consumer protection laws of your state of residence continue to apply to you. You may bring claims in the courts of your state of residence or of California. These Terms contain no arbitration clause and no class-action waiver — you keep all rights to bring claims in court.
12. Changes to these Terms
We may update these Terms. Material changes will be announced in the App with the new version and date, and your continued use after the effective date constitutes acceptance. The current version is always available at fluxtribe.net.
